Expanded Maternity Leave: Soon to be an R.A


Senate has given the green light for the  bill on extended Maternity Leave .In Monday’s senate hearing, Senate Bill 2982 or the Expanded Maternity Leave Law of 2015 gained the votes of 19 senators.

So what changes will this proposed bill bring to expecting mothers of the Philippines?

Expanded Maternity Leave Law of 2015 will extend the leave benefits of mothers who have given birth to 100 days.

Under the existing law Republic Act 7322 and Labor Code of the Philippines (Working Conditions for Special Group of Employees) , only 60 days for normal delivery and 78 days for C-Section is mandated.

Mothers who underwent normal or C-Section/Ceasarian section delivery will both enjoy the the 100-days maternity leave. Additional maternity leave of 30 days to be considered as unpaid, may also be availed under the condition that the employee submits early written notice of 45 days before the end of her ordinary 100-days maternity leave.  Once enacted, the Expanded Maternity Leave Law will cover all government and private sector employees.

Sen. Pia Cayetano, chair of the Senate committee on women, children, family, relations and gender equality sponsored this Expanded Maternity Leave bill. Reports say that according to Sen. Cayetano, the prevailing law on maternity leave falls short on 98 days minimum as prescribed by International Labor Organization. Furthermore the senator stated that this bill ” aims to provide mothers with adequate transition time to regain their health and overall wellness as well as to assume their maternal roles before resuming to full-time work.”  

For those who are receiving other benefits given by their employers, Sen. Cayetano stressed that “The expansion of the maternity leave period shall not in any way diminish the existing maternity benefits granted by the employer. It shall not affect the female employee’s security of tenure.

The ball is now in the hands of President Noynoy Aquino, whose signature will propel the Expanded Maternity Leave Law of 2015  to be Republic Act or officially a law.
